Dispute Resolution
1. Informal Resolution
In the event of any dispute or disagreement arising from a project conducted through UnimeStudio, particularly when upfront payments are involved, we encourage you to first seek an informal resolution by contacting our customer support team at support@unimestudio.in. We are committed to addressing your concerns and finding an amicable solution.
2. Mediation
If an informal resolution does not resolve the dispute to your satisfaction, you agree to attempt mediation before pursuing formal legal action. You and UnimeStudio agree to engage in good faith efforts to resolve the dispute through a mutually agreed-upon mediator.
3. Arbitration
If mediation is unsuccessful or not applicable, both parties agree that any dispute or claim arising out of or in connection with a project shall be settled by arbitration. The arbitration shall be conducted in accordance with the rules of India Court.
4. Project Payment and Refund
If a dispute arises due to failure to deliver on time, failure to provide the required result, or a request to end the project with upfront payments involved, the following terms apply:
- Delivery Delay: In the event of a delay in project delivery, UnimeStudio will make all reasonable efforts to expedite project completion. If the project cannot be completed to your satisfaction within a reasonable time frame, a partial refund of the upfront payment may be offered, subject to negotiation.
- Failure to Achieve Result: If UnimeStudio fails to provide the required project result, you may be eligible for a partial refund, as determined through arbitration or mediation.
- Change in Project Scope: If you have new project requirements and wish to end the project, any refund or payment adjustment will be determined based on the work completed and the additional requirements introduced.
5. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes or claims shall be subject to the exclusive jurisdiction of the courts of India
6. Class Action Waiver
You and UnimeStudio agree that disputes will be arbitrated on an individual basis and not on a class-wide or consolidated basis. There shall be no right or authority for any claims to be arbitrated or litigated on a class action or collective basis.
7. Legal Fees
In the event of a dispute requiring legal action, the prevailing party shall be entitled to recover reasonable legal fees and costs associated with such proceedings.
